Construction Defect Alert--Suit for ADA Non-Compliance
An advocacy organization for persons with disabilities is suing the city of Ypsilanti, Michigan for not constructing curb ramps and intersections according to standards outlined in the Americans with Disabilities Act. The curbs and intersections were part of $34 million street rebuilding project completed last year.
The class-action lawsuit was filed in federal district Court by the Ann Arbor Center for Independent Living and claims the city has spent misspent millions in federal, state and local taxpayer dollars The advocacy organizations President remarked: "If you are blind or in a wheelchair and the curb is not cut to code, you have to travel in the street rather than in the sidewalk, and that's not a good thing."
