Reactions to Kelo
The Construction Law Blog reports on the public backlash triggered by the Supreme Court's decision in Kelo v. City of New London on eminent domain.
Ironically, the backlash is over the Court's lack of judicial activism. And the local movements to enact restrictions on the use of eminent domain for economic development seem to confirm the Court's belief the issue should be decided by the states not the federal courts.
