My Denny Crane Moment

I had a Denny Crane-absent-minded moment yesterday. Trying to do my legal maven thing, I offered to send an attorney on a listserv I belong to a recent article I had written for a seminar on Mississippi construction lien law.

The attorney-in-need took me up on my offer. Several other listserv members did too.

I quickly found the article on my server. But I also found I wrote the article for a seminar back in 2000, not recently.

I resolved to update the article and send it on, then recalled that my friend and peer Robert Wise over at Wise, Carter spoke on liens at a seminar earlier this year. Checking his web site I discovered Robert had posted his article. I also discovered the article covered Mississippi lien law better than my article had.

I recommend Robert's article over my own with two reservations: (1) the legislature amended the statute of limitations on private contract bond claims, section 85-7-189 of the Mississippi Code, effective July 1 of this year; and (2) Robert reads the statute prior to its amendment and the Fifth Circuit decision interpreting the statute more narrowly than I do.
