Construction Litigation Evidence: the Waybackmachine
I am presently prosecuting a civil RICO/ business tort case in which one of the key issues was the contents of the defendant's web site in 2004.
The defendant modified the site once it found out my client was investigating its actions, but we were able to retrieve the evidence we needed using the Internet Waybackmachine.
Construction companies and developers often post important ionformation about themselves on their web sites. I just used the Waybackmachine to confirm a construction manager dropped a construction project gone bad from its web resume. Do you think I might use that fact in cross-examination--you betcha!
Bob Kraft's P.I.S.S.D. posts on using the Waybackmachine to gather evidence about the business you are suing or that is suing you.
